Can Microsoft find out if you have a old HDD in a slim 360?

I've know that they will ban you from xbox live if they found out that you have any other HDD other than ones that were designed for it, I guess that they could find out if there is some kind of signature on it that can be read over their network, which the old ones would have a signature but it could be different from the slim. So has anyone been kicked off for this?
